Level 3 Code Yellow Police drones switch to non-lethal, dissuasive tactics. Getting caught means custody with a probable sentence.
Level 4 Code Red Police are now authorized to use light lethal weapons; their goal is to end the chase quickly. Custody on capture — now under live fire.
Level 5 Code Black Heavy lethal weapons are in play to end the chase at all costs; the police will do whatever it takes. The highest-force response in the game — surrender is the cheap way out.

Surrender vs. getting caught

Official pre-EA design The announcement says that at any wanted level you can surrender for a lower sentence and bail, or keep trying to evade. If you surrender or are caught, it describes custody, fines and possible jail time. This confirms the intended option, not the current input: the site does not yet have a current-build screenshot showing the surrender prompt or key.

One multiplayer silver lining from the same announcement: while you are in custody, your friends can join your game, visit you, and take care of your crops and cattle.

Evasion: how the search ends

Official Losing the pursuers is not instantly over: police cars continue searching for you briefly. If they catch you again during that window, the chase restarts. If you manage to stay hidden for a while, you are eventually considered evaded — and a successful evasion wipes your fines and lets you keep all your loot.

So the risk/reward trade at high wanted levels is explicit: surrender early for reduced fines and bail, or gamble on hiding through the short search window for a clean slate.

Can I just pay my way out of a wanted level?

At Level 1, yes — paying the fine resolves it peacefully with no custody. From Level 2 upward, surrender or capture means custody, a cell, fines and possibly jail days; surrendering still reduces the sentence and bail compared with being caught.

When do the police start using lethal force?

Level 4 (Code Red) authorizes light lethal weapons and Level 5 (Code Black) brings heavy lethal weapons. Levels 1–3 are non-lethal: fine collection at Level 1, surrender pressure at Level 2, and non-lethal dissuasive tactics at Level 3.

I lost the cops — why are police cars still after me?

That is the official search behavior: police cars keep searching briefly after you break the chase, and being spotted restarts it. Stay hidden through that window and you are considered evaded — fines wiped, loot kept.

Is surrendering ever worth it at Level 5?

Per the official notes, surrendering at any wanted level — including Level 5 — leads to lesser fines and fewer jail days than being caught, while a successful evasion wipes fines entirely. The choice is reduced penalty versus all-or-nothing escape under heavy lethal force.
